James and Jenet Maxwell  and their children joined the immigration of Scottish families and sailed from Portsmouth, England on November 22, 1852 aboard the "Java".  James, gave his occupation as a farmer and paid E4.10.0 toward the fares of "self and family"  

The Passenger List for the Java for this voyage included:

MAXWELL Janet 37 and family
MAXWELL Mary 13 and family
MAXWELL Johanna 10 and family
MAXWELL Thomas 7 and family
MAXWELL Jane 5 and family
MAXWELL Elizabeth 3 and family

During the voyage there was a severe outbreak of gastroenteritis compounded by the wrong food for the sick.  When the "Java" arrived in Sydney on April 24, 1853, the Health Officer’s Report for the Arrivals of Port of Sydney found, "There have been 37 deaths, 41 children, chiefly from diarrhoea. 1 boy 14 years. 8 women. No contagious diseases. No sickness except chronic disease."
